Terms and Conditions of Sale

1. Seller identification
These Terms and Conditions of Sale (T&Cs) govern the contractual relationship between SwissForge3D, a sole proprietorship, owner: Vincent Buttitta, Impasse de Riombochet 32, 1673 Promasens, canton of Fribourg, Switzerland (hereinafter "the Seller"), and any customer placing an order via the website or by requesting a quote (hereinafter "the Buyer").

2. Scope of application
Any order or quote request implies full and unconditional acceptance of these T&Cs by the Buyer. The T&Cs in force at the time of the order are those applicable to the contract.
3. Products and services
SwissForge3D offers two types of service:
- Online shop: 3D printed parts available in stock, delivered as-is.
- Custom printing: parts produced according to files and specifications provided by the Buyer, subject to prior quote.
Photos and visuals are for illustration purposes only. Essential product characteristics are stated in the descriptions. For custom parts, specifications are defined during the quoting process.
4. Quotes and custom orders
Quote requests are processed as quickly as possible depending on project complexity. The quote is sent by email and is valid for 30 days from the date of issue.
An order is only confirmed once the Buyer has accepted the quote in writing and full payment has been received. The production lead time is specified in the quote based on project complexity.
5. Pricing
Prices are in CHF. VAT is not applicable (turnover below the registration threshold). SwissForge3D reserves the right to modify its prices at any time. Products are billed at the price in force at the time the order is confirmed.
6. Payment
Payment terms are specified in the quote or at the time of ordering. Full payment is required before production begins for custom orders. No order will be dispatched before full payment is received.
7. Delivery
SwissForge3D ships within Switzerland only. Shipping costs are indicated at the time of ordering.
- In-stock items: dispatched within 2 to 5 business days after receipt of payment.
- Custom parts: lead time defined in the quote based on project complexity.
Lead times are provided as estimates. SwissForge3D cannot be held liable for delays attributable to carriers or exceptional circumstances.
8. Right of withdrawal
Under Swiss law, custom printed parts are excluded from the right of withdrawal as they are manufactured according to the Buyer's personalised specifications.
For in-stock items, any complaint must be sent to contact@swissforge3d.ch within 14 days of receipt. Return costs are the Buyer's responsibility unless a defect is identified upon receipt.
9. Warranties and liability
SwissForge3D guarantees that parts conform to the specifications validated at the quoting stage. In the event of a proven defect attributable to my production, I undertake to reprint the part or refund the Buyer.
SwissForge3D is not liable for damage resulting from improper use of the parts, an incorrect 3D file provided by the Buyer, or unauthorised modification of the parts.
Fused Deposition Modeling (FDM) 3D printing has technical limitations inherent to this manufacturing process: parts are not perfectly watertight without post-processing (varnish, resin, etc.), dimensional tolerances are on the order of ±0.2 to 0.3 mm, and mechanical strength varies depending on print orientation and infill density. Where the Buyer has been informed of these limitations and nonetheless chooses to confirm an order for a given use (water immersion, mechanical stress, heat exposure, etc.), SwissForge3D cannot be held liable for consequences resulting from these characteristics inherent to the process.
10. Intellectual property
Original creations by SwissForge3D: 3D models designed by SwissForge3D (keychains, lightboxes, personalised decorations, wall decor and any other original creations present or future on the site) are protected by copyright in accordance with the Swiss Federal Act on Copyright (CopA) and applicable international conventions.
It is strictly forbidden to reproduce, copy, modify, redistribute or commercially exploit these creations, in digital form (STL, OBJ, 3MF or other files) or physical form, without prior written authorisation from SwissForge3D. Any violation may be subject to civil and criminal proceedings.
Files submitted by the Buyer: The Buyer certifies that they hold all rights to the 3D files they submit to SwissForge3D and releases the Seller from any liability in the event of a third-party rights infringement. Client files are kept confidential and are not reused without express authorisation.
11. Personal data
Data collected at the time of the order is used solely for its processing and follow-up. It is neither sold nor transferred to third parties without consent. See my privacy policy.
12. Applicable law and jurisdiction
These T&Cs are governed by Swiss law. In the event of a dispute, the parties undertake to seek an amicable resolution. Failing that, the competent court is that of the Seller's domicile, in the canton of Fribourg, Switzerland.
